Shawnigan Lake Soil Fight Continues

The Cowichan Valley Regional District is firing back after a BC Court of Appeal Judge granted a stay earlier this month, to allow operators to continue dumping at a contaminated soil landfill near Shawnigan Lake.
The CVRD filed an application to the Court of Appeal to discharge or vary that order yesterday. CAO Brian Carruthers says they are concerned the stay is not protecting the CVRD’s interest in enforcing that zoning, and the undertaking for damages is not enough if the material has to be removed in the future.
The CVRD is asking for a $12 million deposit to cover costs or damages, should the waste need to be removed.
The application to discharge or vary the order will be heard on Monday May 9th in Vancouver by the BC Court of Appeal.
