The application to discharge or vary the order on the contaminated soil site on Stebbings Road is back in court today (May 9) in Vancouver at the BC Court of Appeal.
The order, granted last month allowed South Island Resource Management to complete contracts for the landfilling of contaminated soil on the site to which it was contractually committed as of March 21, 2016.
Among other things, the CVRD is asking that, if the stay is to remain in effect, then the order should require the appellants to post security in the amount of $12 million for the cost to remove any waste material imported to the property.
