A Cowichan Valley crematorium has been given the green light to operate as a commercial business by the province’s appeal court.
The Court of Appeal has overturned a lower court’s decision based on the CVRD’s parks and institutional zone.
The owner of the Cowichan Valley Crematorium is Harold Wallace.
The crematorium was originally deemed as illegally zoned for commercial use by the CVRD, however, the trio of appeal court justices agreed the bylaw did not distinguish between commercial and non-commercial institutions.
In addition, they agreed the crematorium was an institution serving public needs, and as a result permitted in the zone.
