National lawsuit against opioid makers, marketers and sellers allowed to go ahead

A national class-action lawsuit against drug companies that make, market, and sell opioids in BC has been certified by the BC Supreme Court.

Justice Michael Brundrett made the decision on January 22, in a case involving the province and drug manufacturer Apotex.

The defendants in the action include Apotex, Johnson & Johnson, Purdue Pharma, Shoppers Drug Mart, and more.

In a statement, Attorney General Niki Sharma said the decision means BC can now proceed, on behalf of federal, provincial and territorial governments, to recover the costs of treating opioid-related diseases that were allegedly caused by the industry’s wrongful conduct.

The legal action was launched in 2018 in BC on behalf of all jurisdictions in Canada.
