BC Court of Appeal Overturns BC Supreme Court in Shawnigan Contaminated Soil Fight

Shawnigan Lake residents are disappointed by the most recent decision regarding the contaminated soil facility.
The BC Court of Appeal allowed the appeals of Cobble Hill Holdings, South Island Aggregates, and South Island Resource Management…finding the province has jurisdiction over quarries and its site reclamation.
This decisions resulted in the court overturning the BC Supreme Court’s orders, which stated the contaminated soil treatmen facility to be a non-permitted use on the property under the CVRD’s zoning bylaw.
Director for Shawnigan Lake Sonia Furstenau was with over 50 people in Shawnigan Lake, awaiting the decision this morning.
Furstenau says the community is disappointed, but will not lose hope. She says they are still waiting on results from the Shawnigan Residents Association case before the BC Supreme Court concerning a judicial review of the environmental appeal board decision.
The Court did uphold the order preventing the operators from running the soil treatment facility.
